"Likelihood of confusion" is the standard courts use to decide claims of trademark infringement as well as a fair description of the state of intellectual property, and discussions about it, in the 21st century.

Bloggers and Tsunami Relief
Bob Cox at TheNationalDebate has all the latest on the tsunami relief effort being spearheaded by bloggers via the Media Bloggers Association on their beta site. This is a good thing!

The whole issue of the legacy media counter-attacking has not been adequately thought through. There is a lot of money and power at stake, and you are absolutely right that unfair methods and abuse of the legal process are little short of inevitable.

We need to be alert to this. Bloggers are amateurs, and have virtually no resources compared to any media company, and serious costs or risks could shut down most of the blogosphere very quickly.
